Alejandro N. Gómez-Strozzi is a leading international trade attorney, providing advisory and consulting services related to international trade compliance, antidumping, customs, foreign trade, competition, antitrust, regulatory, and Mexican administrative law. He is a partner in the firm’s International Trade and Transactions Practices, where he advises major multinational companies in the automotive, steel, consumer products, and other sectors.
Alejandro provides advice regarding available foreign trade programs, tax implications of foreign trade operations, implementation of free trade agreements entered into by Mexico, customs procedures, trade compliance, and unfair trade practices. He represented a number of industries during the full negotiating process to conclude the United States-Mexico-Canada Agreement (USMCA). He has private and public sector experience in the alternate dispute resolution processes of the World Trade Organization, and the now USMCA (formerly NAFTA).
As the lead trade consultant of the Mexican associations and confederations of pork, poultry, and beef producers, Alejandro provides advice in tariff and nontariff trade regulations and standardization. He participates in the defense of their interests in both domestic courts and international trade panels.
Alejandro has experience in private practice and government as well. During President Vicente Fox´s administration (2000-2006), Alejandro was the Undersecretary of Economy in charge of foreign investment, standards, and trade remedies. In addition, he previously led the Mexican Investigative Authority regarding trade remedies and safeguards (UPCI) in the Ministry of Economy. Alejandro began his legal career by clerking in Mexico´s Supreme Court of Justice and is admitted both across Mexico and in New York.
Fernando Camarena is a senior business and legal advisor on international and domestic tax issues in Mexico, providing both tax counseling and assistance with litigation. He is a partner in the Taxation, Employee Benefits and Executive Compensation, and Transactions Practices. He represents medium-sized companies to Fortune 500, FTSE 100, and other global and brand name corporations in the energy, manufacturing, nutritional supplement, insurance, and other industries.
Fernando is frequently sought after by clients for his broad understanding of tax laws and systems around the world. He is described by clients in the Chambers & Partners Latin American Guide as having deep financial knowledge that “allows him to understand not only the tax implications but also the business with which he is dealing.” With referrals from clients and major law firms around the world, he is passionate about clients’ primary goal of conducting business in Mexico as tax efficiently as possible.
Fernando has extensive experience in M&A and corporate transactions. He has a deep understanding of the corporate vision, as well as the technical transaction specifics for U.S. and foreign corporations, such as the permanent establishment issue that arises in joint ventures, especially in the energy industry, and the country-specific treaties on double taxation. His experience also encompasses insurance regulatory and government contracts matters.
U.S. and European companies are confident when they hire Fernando that he has superior international tax knowledge, and that he understands the entire business picture and structure under which they are operating. American clients appreciate that he knows the reporting that must be done in the U.S. – FIN 48, which they must file when they have an income tax issue abroad.
Marcos Carrasco-Menchaca is a recognized international trade attorney, advising clients on international trade compliance, customs, free trade agreements, customs litigation, and taxation on foreign trade. He is a partner in the firm’s Transactions and International Trade Practices, where he handles international business transactions, regulatory matters, and administrative litigation.
Marcos is a trusted advisor on foreign trade to major multinational and national companies in the retail, fashion, oil and gas, automotive, auto parts, and manufacturing industries. He has broad experience in the implementation of governmental exportation programs, such as the registration of companies in the Mexican Maquila Program (IMMEX), VAT Certification, Sectorial Promotion Programs (PROSEC) and Drawback, among others. In connection to the foregoing, he advises in the compliance involved with such programs and assists companies during audits performed by the Mexican authorities.
Marcos is also experienced in customs valuation and has assisted global brand name companies in determining whether the payments of royalties, insurance, and freight fees must be considered as incrementing the customs value of imported goods, providing advisory on that regard during audit procedures from the Mexican authorities.
With respect to compliance with Free Trade Agreements provision, Marcos has advised companies in connection with verifications of origin under Free Trade Agreements, during the audit procedure, and in their defense against the denial for the application of preferential duties treatment.
