In the era of Generative Artificial Intelligence, it seems as if how we apply the term Fair Use is changing. The textbook definition of Fair Use, while still relevant and legally binding, is being contented with in the various suits against companies like OpenAI as Stanford Law Professor Mark Lemley explains. The truth is that we are currently in the first generation of AI-related litigation, and how Fair Use will apply to these kinds of cases is up in the air.
